State-Specific Successor Trustee Affidavit & Acceptance Requirements

A successor trustee affidavit documents the change in trusteeship and the successor’s acceptance. It does not replace the trust’s conditions for succession, proof of the prior trustee’s death, incapacity, resignation, or removal, a certification of trust, beneficiary notices, or asset-specific transfer documents.

Important: Complete the affidavit only after confirming that the succession condition has occurred. A notarized signature gives stronger evidence, but the trust and state law control acceptance and notice duties.

How to use the Successor Trustee chart

Confirm that the event causing the successor trustee to serve has occurred and that the trust’s succession requirements have been satisfied. Then review the state row for acceptance, beneficiary-notice, timing, and other special requirements.
